These Terms of Service (the "Terms") are an agreement between you and Flare Built LLC ("Flare Built," "we," "us," or "our"). They govern your use of our website at www.flarebuilt.com and any tools, forms, or content we make available there (together, the "Site").

By visiting or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

These Terms cover your use of the Site itself: browsing it, requesting a free website teardown, and reaching out through our contact form.

They are not the agreement for a project we build for you. The scope, pricing, timeline, deposit, and any Flare Care plan for your project are set out in a separate written proposal that you review and approve. If anything in that proposal conflicts with these Terms, the proposal controls for that project.

Any pricing shown on the Site is a starting point or a range to help you plan. It is an estimate, not a quote, and it can change as we learn what your project actually needs.

Your final pricing, what is included, the payment schedule, and any ongoing Flare Care plan are confirmed in writing before work begins. Nothing on the Site is a binding offer to perform work at a particular price.

From time to time we offer free resources, such as a short website teardown. These are provided for general information to help you decide whether to work with us.

They reflect our opinion and experience, are provided "as is," and come with no guarantee of any particular result. Availability, the number of openings, and the details of any offer can change or be withdrawn at any time.

When you use the Site, you agree not to:

• use the Site in any way that breaks the law or infringes someone else's rights
• attempt to gain unauthorized access to the Site, its servers, or any connected systems
• interfere with or disrupt the Site, for example by overloading it, scraping it abusively, or introducing malicious code
• submit false information, impersonate someone else, or misuse our forms, including the contact form
• copy, resell, or exploit any part of the Site without our written permission

The Site and everything on it, including the Flare Built name, the flame mark, the design, layout, text, graphics, and code, are owned by Flare Built or our licensors and are protected by intellectual property laws.

We give you a limited, personal, non-exclusive permission to view the Site for the purpose of learning about and engaging our services. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written consent.

Ownership of the work we create for you as a client is handled separately in your project agreement.

When you send us information through a form, by email, or by any other means, you confirm that you have the right to share it and that it is accurate.

Please do not send confidential, sensitive, or regulated information through the contact form. If you share ideas, suggestions, or feedback about our Site or services, you agree that we may use them without any obligation or payment to you.

The Site may link to or rely on third-party websites and tools, such as scheduling or social media services. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies.

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error free, or secure, or that any information on it is complete or current. Any statements about speed, performance, or outcomes are general and depend on factors that vary from project to project.

To the fullest extent permitted by law, Flare Built will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site.

Our total liability for any claim relating to the Site will not exceed one hundred United States dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to defend, indemnify, and hold harmless Flare Built from any claims, damages, or costs, including reasonable legal costs, arising out of your misuse of the Site or your breach of these Terms.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date shown below the title. Changes take effect when posted, and your continued use of the Site means you accept the updated Terms.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Site will be handled in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
