What we see rebuilding sites for firms whose reputation outruns their website. No jargon, no hype, just the parts that decide whether a referral calls.

Every post here links its sources. Where a rule or a number is load-bearing we point at the document itself, whether that is a national listing policy, a state statute, or the accessibility standard a court would actually apply. When something genuinely has not been measured, we say so instead of borrowing a vendor's number.

How to Open a Real Estate Brokerage in Sacramento

The state licenses your brokerage once. Everything after that is local, and Sacramento County is not one local. Seven incorporated cities plus a large unincorporated area answer differently on what you register, what you owe and how big your yard sign may be. A ten agent brokerage pays about $8 a year in Elk Grove, about $87 in the unincorporated county and $400 in the City of Sacramento, which issues no business license at all and taxes you per agent instead.

Sacramento Real Estate Brokerage Websites: We Checked 74

The California Department of Real Estate licensed 74 corporations with a Sacramento County address between January 2024 and August 2026. We searched for a website for every one of them on September 2, 2026. Forty-three have nothing of their own, not even a template page. Of the 25 that do, 11 leave the licence number California requires off the homepage, two have broken security certificates, and one homepage renders fifteen characters of text.

Real Estate Broker Supervision Requirements by State

Every state makes you answer for your agents. Only some tell you what that means. California lists seven things supervision consists of, Texas eight, Michigan five, and Florida stops at the word. Sixteen states put the word 'written' next to 'policies' and mean it: Colorado and Montana make every agent sign the manual, Texas has fined a brokerage for not keeping one current, and in Utah, Georgia and Missouri a written policy is the only defense the rule offers when an agent goes wrong.

Real Estate Referral Fees: Who You Can Legally Pay

Three separate bodies of law answer this question, and they disagree. The federal rule most brokers worry about expressly exempts broker to broker referrals, and the agency that enforces it dismissed its last case against a brokerage network with prejudice in February 2025. The rule that will actually discipline you is your own state's, it bars paying anyone unlicensed, and it never changed.

Real Estate Brokerage LLC: Your Entity Needs a License Too

Forming the company and licensing the company are two filings at two agencies, and the formation vendors sell you one of them. Eighteen states answer the question five different ways. California answers it by refusing: its LLC statute bars limited liability companies from rendering licensed professional services, so a real estate brokerage LLC cannot exist there at all.

Real Estate Cold Calling Rules: What Changed in 2026

One brokerage paid $20 million to settle claims that its agents called homeowners on the Do Not Call registry. That is the settled part. The unsettled part is texting: in July 2026 a federal appeals court held that a text is not a telephone call, so homeowners in three states can no longer sue over one. The prohibition survived. The lawsuit did not.

Real Estate Social Media Rules: What Goes in the Post

Texas says the disclosure may sit in your profile if the link is direct. North Carolina says it must be in the post, because there is no one-click rule. Connecticut wants your name in the post and everything else behind a link. Maryland wrote a percentage and a character count into the rule. New York never mentions social media at all. And Utah publishes the fine: $500.

Real Estate Team Name Rules: What You Can Call It

Texas requires a team name to end with the word team or group. New York and Connecticut prohibit the word group outright. California requires a surname. Across the nine states whose rule text we read, exactly one construction is lawful everywhere, and most team branding fails at least one state before the sign is even printed.

Do You Have to Be a Realtor to Use the MLS?

In November 2025 NAR deleted the policy statement backing this requirement, effective with the 2026 handbook. Read the old rulebook and the surprise is what was mandatory and what was not. Endorsing the membership requirement was Recommended. Reporting anyone who asked for access without joining was Mandatory, in every state except the four where NAR had already lost in court.

Are Real Estate Agents Independent Contractors?

Federal tax law gives real estate agents an explicit safe harbor, and it opens with six words that fence it in: for purposes of this title. Three other bodies of law ask the same question separately and can answer it differently, in the same state, about the same person, on the same day. Your written agreement settles one of the four.

Real Estate Broker Trust Account Requirements by State

Ohio's statute says a broker's escrow account shall be noninterest-bearing. Washington's statute requires an interest-bearing one and sends the interest to a state housing fund. Same account, same money, two states, and the law says opposite things. The deposit deadline ranges from the next banking day to no deadline at all, and the amount of your own money you may leave in the account runs from one hundred dollars to five thousand.

Commercial Property Microsites: Who Says They Work?

Nobody has published evidence that a dedicated listing website does anything, and almost every guide recommending one comes from a company that sells them. Meanwhile the rule deciding whether your page can be public at all is federal, it was written before the web existed, and SEC staff has already said the checkbox on your deal room does not satisfy it.

Commercial Real Estate MLS: Why There Isn't One

Residential brokers share listings because a rule makes them. Commercial brokers do not, because no rule does. NAR's own commercial rulebook says submission is voluntary, that a commercial exchange is not an MLS, and that no offers of cooperation can be extended through it. Real Estate E&O Insurance Requirements by State

Fifteen states make errors and omissions coverage a condition of holding a real estate license. In almost all of them the duty lands on you personally, and your brokerage is a separate policy with different numbers. Montana's firm aggregate is triple its individual one. Idaho's is five times. Texas mandates nothing of you and a million dollars of your company.
